Condition of Vehicle

1. You acknowledge that the vehicle is generally in good roadworthy condition. You agree to return the vehicle to Smile Rent a Car in the same condition allowing only for acceptable wear and tear.
2. You agree to maintain oil & water levels as well as tyre pressure during the rental period, to manufacturer’s specifications.
3. You agree to report immediately to Smile Rent a Car any defect or impairment to operating systems of vehicle.


Vehicle Return

1. Vehicles must be returned to the location as agreed on the rental contract. Any additional cost incurred in having to retrieve a vehicle left in an unapproved location will be charged to the hirer.
2. You are responsible for the vehicle during the rental period up until we make our final inspection of the vehicle. This will include when the vehicle is left unattended and our inspection cannot take place for some time.
3. Early returns with less than 24 hours notice prior to original return date no refund applies.


Contract Termination
Smile Rent a Car reserves the right to terminate a contract should

1. The vehicle be driven by person(s) other than those nominated on rental contract
2. The hirer(s) be believed upon reasonable grounds to have made a false statement in relation to this agreement
3. The hirer is found to be in breech or suspected breech of any terms & conditions hereof


Vehicle Usage

Smile Rent a Car does not permit its vehicles to be used in the following manner

1. For commercial purposes, including the transportation of goods, promotional equipment, freight or cargo and/or passengers for hire/reward.
2. For the transportation of animals or pets
3. To travel on any unsealed road including beach and forest paths
4. To be transported over water by barge or vehicle ferry unless approval is granted by management
5. To carry roof racks, including soft racks for surfboards
6. For use on Motor Sport racing venues of any design


Exclusions to Cover “”Items not Covered””
Damage not covered

1. Damage or loss from theft where vehicle is left unlocked or unsecured
2. Damage or loss to any personal property of the renter or passengers
3. Damage caused by roof racks, snow chains, or unsecured loads
4. Damage caused by deliberate, reckless, careless or negligent behavior and reversing damage
5. Damage or loss occurring to vehicle outside the designated area of use
6. Damage or loss occurring during unauthorized towing or ferrying of vehicle without the consent and approval of Smile Rent a Car
7. Damage or Loss to the undercarriage of the vehicle due to contact with any obstacle or road surface, regardless of cause and damage to the roof of ay vehicle due to overhanging trees or low clearance bridges & carports etc.
8. Damage or loss occurred as a failure of driver/renter to stop after recognizing possible mechanical or physical problems with the vehicle, including overheating, fluid loss, excessive tyre wear and loss of tyre pressure
9. Damage or loss to overhead parts of the vehicle including aerials where vehicle has been driven under an object lower than vehicle clearance height
10. Damage or loss incurred whilst vehicle is used in an illegal manner, including

i) Acts of terrorism
ii) Driven under the influence of alcohol or drugs
iii) Violation of traffic codes

11. Damage or loss occurring to vehicle whilst be driven on unsealed roads
12. Damage to vehicle where vehicle is immersed in water either partially or fully regardless of cause
13. Damage or loss to the tyres, such as punctures, abrasions and cuts
14. Damage to windscreens such as cracks, stars and chips
15. Damage or loss incurred whilst the vehicle is being operated in any race, speed test, rally or contest
16. Damage or loss incurred whilst vehicle is being driven outside the specified time limits of the contract without the express permission from Smile Rent a Car
17. Vehicles involved in accidents where no other vehicle is involved. (SVA single vehicle accidents damage liabillity $5000.00)
